“Fynch,” “we,” “us,” or “our”: Refers to Quixo AG, the Swiss-based fintech operator of the Fynch platform and member of VQF (Verein zur Qualitätssicherung von Finanzdienstleistungen).
“Personal User,” “you,” or “your”: An individual consumer or private user accessing or using the Services for personal, non-commercial purposes.
“Account”: The multi-currency account or user profile you create on the Fynch platform.
“Site”: fynch.ch and any subdomains.
2. Eligibility
You must be at least 18 years of age and have the legal capacity to enter into these Terms.
By creating a Personal Account, you warrant that all registration information you submit is accurate, current, and complete.
3. Personal Account Registration & Security
Account Creation: To use certain Services (e.g., multi-currency accounts, card issuance), you must register for a Personal Account. We may require you to provide KYC documents in compliance with our AML/KYC policies and VQF requirements.
Security Obligations: You are responsible for keeping your login credentials confidential and for all activities under your Account. Notify us immediately if you suspect unauthorized access.
4. Personal Use of Our Services
Multi-Currency Accounts: You may hold, send, and receive funds in multiple currencies. You are responsible for abiding by all applicable currency and cross-border regulations.
Debit & Credit Cards: If eligible, you may obtain virtual or physical cards through our issuing partners. Card usage is subject to separate Cardholder Agreements.
Cross-Border Payments: We facilitate international transfers with applicable fees and exchange rates. Transfer times vary based on banking regulations and third-party partners.
Foreign Exchange (FX): Currency conversions are provided on a best-effort basis, subject to market fluctuations.
5. Fees & Charges
You agree to pay applicable fees (e.g., monthly maintenance, transaction fees).
We reserve the right to change our fee structure at any time, but changes will not apply retroactively to transactions already initiated.
6. Compliance & AML
Regulatory Compliance & VQF Membership: We operate under a Swiss SRO license and hold membership with VQF, which provides direct oversight of our AML obligations.
AML & KYC Policies: We have developed our own AML/KYC policies in line with Swiss regulations and VQF standards.
User Cooperation: You agree to provide any necessary documentation for due diligence. Failure to comply may result in suspension or closure of your Personal Account.
7. Prohibited Activities
Lawful Use: You must use our Services only for lawful personal purposes.
No Illegal Use: You may not use our Services for money laundering, terrorism financing, fraud, or other illegal activities.
Risk Disclosure: FX and cross-border payments carry risks due to market volatility. You acknowledge and accept these risks.
8. Intellectual Property
All content, branding, and software are property of Fynch (Quixo AG) or our licensors. You are granted a non-exclusive license to use the Services for personal use. Unauthorized reproduction, distribution, or modification is prohibited.
9. Limitation of Liability
No Warranty: The Services are provided “as is” without warranties of any kind.
Limited Liability: To the fullest extent permitted by law, we will not be liable for indirect or consequential damages related to your personal use of our Services.
Cap on Liability: Our total liability to you is limited to the fees paid by you in the preceding three (3) months.
10. Termination
We may terminate or suspend your Personal Account if we suspect a violation of these Terms or any applicable law.
You may close your Personal Account at any time, subject to settling any outstanding fees or transactions.
11. Governing Law & Dispute Resolution
These Personal Terms are governed by Swiss law. Any dispute arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in Zürich, Switzerland.
12. Changes to Personal Terms
We reserve the right to update these Personal Terms at any time. Changes will be posted on our Site with an updated “Last Updated” date. Continued use of the Services after changes indicates your acceptance.

Business Terms

2. Eligibility & Authority
The individual accepting these Terms on behalf of a Business User represents and warrants that they have the authority to bind the company or entity to these Terms.
Business Users must comply with all relevant laws, including those governing business registrations, tax, and financial operations.
3. Business Account Registration & Security
Account Creation: To use the Services for business purposes, you must register for a Business Account. We may require corporate documentation, beneficial ownership information, and KYC/AML documents in line with Swiss regulations and our VQF obligations.
Security Obligations: The Business User is responsible for maintaining the confidentiality of login credentials and for all activities under the Business Account.
4. Business Use of Our Services
Multi-Currency Corporate Accounts: Business Users can hold, receive, and send funds in multiple currencies. You must adhere to all cross-border payment and currency control regulations relevant to your jurisdiction.
Cross-Border Payments & FX: We facilitate international transfers and FX conversions for business transactions, subject to market fluctuations and applicable fees.
Corporate Cards: Where available, you may obtain debit or credit cards for authorized employees. Separate corporate Cardholder Agreements may apply.
5. Fees & Charges for Business Users
Business fees may differ from personal fees. You agree to the fees outlined in your Business Account agreement or schedule.
We reserve the right to adjust our fee structure with notice. Fee changes do not apply retroactively to completed transactions.
6. Compliance & AML
Regulatory Compliance & VQF Membership: We operate under a Swiss SRO license and hold VQF membership, providing direct oversight of our AML obligations for business transactions.
Business AML & KYC: We have developed comprehensive AML/KYC policies specifically for business clients, requiring corporate documents, proof of beneficial ownership, and more as needed.
User Cooperation: Failure to provide required documentation may lead to suspension or closure of the Business Account.
7. Representations & Warranties
By using our Services, you represent and warrant that:
You will comply with all applicable laws, including tax, anti-bribery, and export regulations.
You are not using our Services for prohibited industries or illegal activities (e.g., money laundering, terrorism financing, fraud).
All information provided (including corporate and financial details) is accurate and up to date.
9. Limitation of Liability
No Warranty: The Services for Business Users are provided “as is,” without warranty or guarantee of uninterrupted availability.
Liability Cap: Our liability to any Business User for damages, whether in contract or tort, shall be limited to the total fees paid by that Business User in the preceding three (3) months.
Indirect Damages: We are not liable for indirect, consequential, or special damages arising from business use of the Services.
10. Indemnification
Business Users agree to defend, indemnify, and hold harmless Fynch (Quixo AG), its affiliates, officers, and employees from and against any losses, damages, or claims arising out of or in connection with:
The Business User’s breach of these Terms.
Any violation of law or regulation by the Business User.
Any claim of infringement relating to data or content provided by the Business User.
11. Termination
We reserve the right to suspend or terminate any Business Account if we suspect non-compliance with our Terms, AML/KYC requirements, or any applicable law.
The Business User may close its account at any time, subject to the settlement of outstanding fees and obligations.
12. Governing Law & Dispute Resolution
These Business Terms are governed by Swiss law. Any dispute, claim, or controversy arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Zürich, Switzerland.
13. Changes to Business Terms
We may revise these Business Terms at any time. Updated Terms will be posted on our Site with an updated “Last Updated” date. Your continued use of the Services after such revisions indicates acceptance of the new Terms.
